S. 501: Fair Prescription Drug Competition Act

It is clear that Congress has declared war on the middle class and the poor.  This new bill, S. 501 is aimed at taking away our ability to afford prescription drugs.  The Fair Prescription Drug Competition Act is anything BUT fair!  Let’s examine the text of the bill in order to see just how dastardly these Congressional brown nosers to Big Pharma are:

To amend the Federal Food, Drug, and Cosmetic Act to prohibit the marketing of authorized generic drugs.

You read that correctly! They are trying to ban generic drugs. These are the drugs that many low and middle income people/families depend on because they are more reasonably priced. And in this economy no less.  Does anyone still think those fools in Congress represent them?

Mr. ROCKEFELLER (for himself, Mr. SCHUMER, Mr. KOHL, Mr. LEAHY, Mr. BROWN, and Mr. INOUYE) introduced the following bill; which was read twice and referred to the Committee on Health, Education, Labor, and Pensions

The bill is very short, vicious, and to the point. I can’t imagine how high up the bottoms of Big Pharma these men’s noses are, but surely it must be dark and stinky for it smells to high heaven from here!

The bill is short and you will see that little needs to be explained.  If one of these Congresswomen or men from this committee is your representative, it is your duty as a Citizen of this country to write to them and tell them what you think of this bill.  I can only bring it to light and contact those in my own area.


(a) In General- Section 505 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 355) is amended by adding at the end the following:

‘(w) Prohibition of Authorized Generic Drugs-

‘(1) IN GENERAL- Notwithstanding any other provision of this Act, no holder of a new drug application approved under subsection (c) shall manufacture, market, sell, or distribute an authorized generic drug, direct or indirectly, or authorize any other person to manufacture, market, sell, or distribute an authorized generic drug.


For purposes of this subsection, the term ‘authorized generic drug’–

‘(A) means any version of a listed drug (as such term is used in subsection (j)) that the holder of the new drug application approved under subsection (c) for that listed drug seeks to commence marketing, selling, or distributing, directly or indirectly, after receipt of a notice sent pursuant to subsection (j)(2)(B) with respect to that listed drug; and

‘(B) does not include any drug to be marketed, sold, or distributed–

‘(i) by an entity eligible for exclusivity with respect to such drug under subsection (j)(5)(B)(iv); or

‘(ii) after expiration or forfeiture of any exclusivity with respect to such drug under such subsection (j)(5)(B)(iv).’.

(b) Conforming Amendment- Section 505(t)(3) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 355(t)(3)) is amended by striking ‘In this section’ and inserting ‘In this subsection’.

I don’t think it gets any clearer than that. We should wall off D.C. and let the slimy b-stards stew in their own little juices. They can do no harm if they are all enclosed in one small area, now can they? Course, my preference would be to make sure none of these boys EVER gets elected again. I’m one for throwing ALL the current bums out of office, depriving them of their benefits, and forcing them to live under the same rules as they make for us. Now, that would be justice don’t you think?

Is your Representative, (cough, cough) listed here? You have a stake in this whether you take prescriptions or not. Millions of disabled, veterans, poor and the elderly depend on these generic drugs in order to afford their prescriptions. Without them these folks won’t be able to get well. Is this the Republic for which we stand? I don’t think so!  Of course John McCain would be on this committee!  I’ve already contacted him on numerous occasions but he ignores me utterly.  Is that how these men and women think of us?  As ignorable, nothing to bother with?  Oh, what a shake-up they have coming.  But We the People need to organize better and kick the bums out!

An agency that has been working long and hard on this very issue is Health Freedom USA.  On their website is the ability to learn about these bills and click on a link to send your < sarc > Representative < /sarc > your opposition to these fake food safety bills.  This includes S.3002.  Here is the link: HealthFreedom USA If we can flood the Senate and this committee with emails they might get the feeling the Citizens of this country are paying attention and they cannot sneak bad bills by us without us reacting to them.  If enough people speak their minds, nicely, we will see changes.  If these men and women know their jobs are threatened come the next elections, they might think twice in giving the fraud and death administration any more authority.

So I found it extremely interesting when the McCain withdrew his support for the bill we know was sponsored by Big Pharma.  Finding a reputable source for those comments he might have made or his office might have made proved difficult.  I finally found this article at Over the Counter Today:

McCain Withdraws Support For Dietary Supplement Safety Act

A Senate staffer confirmed that Sen. John McCain no longer supports a bill he introduced to significantly tighten regulatory requirements for dietary supplements.

McCain offered the Dietary Supplement Safety Act of 2010, S. 3002, in February. The Arizona Republican will now collaborate with Sen. Orrin Hatch, R-Utah, on revised legislation that allegedly provides for transparency and safety within the supplement industry but without the intensive regulatory intervention proposed in S. 3002. No timeline is set for introduction of a new bill.

See, this isn’t over yet.  They will just collaborate some more and come up with a new attack strategy.  Only this one we might not see coming.  Vigilance is everything lately.  Don’t close your eyes or you might miss the antics of the elite.  It was s very informative article though.  I hope you will read it.  Here is another from the Wall Street Journal:

NEW YORK (Dow Jones)–Shares of nutritional supplement makers climbed Monday as Sen. John McCain (R., Ariz) withdrew his support for legislation to regulate dietary supplements.


In February, McCain and Sen. Byron Dorgan (D., N.D.) introduced the Dietary Supplement Safety Act of 2010 to give the U.S. Food and Drug Administration more power to oversee the dietary supplement industry amid concerns the products contain harmful, hidden ingredients. The proposal would have given the FDA powers to recall dietary supplements from the marketplace and would require companies to list all ingredients in the products.

I think McCain got the message when over 89,000 email messages were sent telling those in charge of the bill that it had to die. It was a horrible bill. Not in the interests of We the People at all.  By no means should we sit back and congratulate ourselves on stopping this one though.  There are more of these fake food bills coming up.  One to watch right now is S.510, a gargantuan bill with confusing points.  I’m trying to wade through it now.  At first I thought the whole bill had been *struck out* but midway down the massive text the updated version starts.  It is not for the feint of heart.

At the heart of all this is the fact that I don’t believe those in Congress know better than I what is good for me.  We don’t elect these men and women to play Lord and Lady over us, we sent them to make sound decisions.  Since they are failing that left and right, what reason have we to trust them?  None at all.  My next article will be on the

S. 3081; A bill in the US Congress: A bill to provide for the interrogation and detention of enemy belligerents who commit hostile acts against the United States, to establish certain limitations on the prosecution of such belligerents for such acts, and for other purposes.

There goes the First Amendment!  Another of McCain’s brilliant ideas. Did I hear Camp FEMA?  Are you people sure you want this man in Congress???  I mean really?
