We have a post trial motion hearing this Thursday at 1430 if anyone wants to make it. It will be interesting as we have a few motions for a new trial (because of the feds covering up exculpatory evidence) and acquittal (lack of evidence of any crime) that will be heard. Feel free to dig in; we are all at risk over this.

Just when I thought it was almost safe to go in the water again. I was feeling some relief over a story that the Dems were going to have to tiptoe around gun control in the Pennsylvania debate coming up.

I thought when caught the tail end of a radio report on this particular case that they were talking about the DC gun ban case. That was bad enough. This is nuts!

I’d like to know what the prosecution’s actual arguments are.

“The National Firearms Act (NFA), cited as the Act of June 26, 1934, Ch. 757, 48 Stat. 1236, as amended, currently codified as Chapter 53 of the Internal Revenue Code, 26 U.S.C. § 5801–5872, is a United States federal law passed in 1934 that, in general, imposes a statutory excise tax on the manufacture and transfer of all Title II weapons and mandates the registration of those weapons.

The Act was passed after the repeal of Prohibition, and it mandates that transfers of the covered firearms across state lines be reported to the Department of the Treasury (this function has since been transferred to the Department of Justice). The transfer tax of $200 placed on the transfer of firearms controlled by the Act was roughly equivalent to five months’ salary in 1934.”

The NFA is an infringement of our right to keep and bear arms suitable for militia use.

The Second Amendment has been getting seriously chipped away since 1934.

The Second Amendment was then challenged again in 1939 by a fake case concocted by the anti-gun, anti-2nd-Amendment goons in FDR’s gang (Homer Cummings, Heartsill Ragon, et alii).

If any of you folks reading this now are alarmed at what the government is doing to Olofson these days, you should read up on the origins of the Anti-2nd-Amendment movement in the stuff I’ve mentioned here.

The whole case of U.S. v. Miller was a fabrication.

Fortunately, the goons who fabricated it did not foresee the eventuality that the decision would be written by one of their direst enemies–someone who made the outcome of the case virtually self-contradictory and impossible to interpret in a straightforward way.

If U.S. v. Miller means only what it says–i.e., it does not mean what its fabricators intended it to mean–then the government can only “regulate” that would be UNsuitable for military use.

Which means that it cannot “regulate” fully automatic machine guns, NFA notwithstanding (see page 165 of “That Every Man Be Armed,” by scholar Stephen Halbrook for explanation of this).
